HomeMy WebLinkAboutCity Council Resolution 1993-215CITY OF PLYMOUTH RESOLUTION 93- 215 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR JANCO, INC. FOR "SWAN LAKE SOUTH" LOCATED NORTHEAST OF ROCKFORD ROAD AND NORTHWEST BOULEVARD (92112) (RPUD 92-6) WHEREAS, the City Council has approved the Final Plat and Development Contract for Janco, Inc. for "Swan Lake South" located northeast of Rockford Road and Northwest Boulevard; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Park dedication requirements shall be fulfilled by the dedication of park/trail land (Outlots A, B, C, and D) and payment of park fees at the time of final platting. 4. The developer shall construct the trails in Outlots A, B, C, and D per City standards per financial reimbursement for construction of the trail shall be determined at the time of construction. Construction shall be complete prior to issuance of building permits on adjacent lots. 5. The deeds for Outlots A, B, C, and D shall be transferred to the City prior to filing the plan with Hennepin County. 6. No Building Permits shall be issued until a Contract has been awarded for the construction of municipal sewer and water. 7. Removal of all dead or dying trees from the property at the owner's expense. 8. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 9. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 10. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 11. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 92-6 per Section 9 of the Zoning Ordinance. Resolution No. 92-215 Page Two, File 92112 12. Access shall be limited to internal public roads and prohibited from Northwest Boulevard and Rockford Road (County Road 9). 13. The Development Contract as approved by the City Council shall be fully executed prior to release of the Final Plat. 14. Approved setbacks are: a. 10 foot side yard setback b. 35 foot front yard setback C. 25 foot rear yard setback 15. The petitioner shall work in close coordination with Hennepin Parks to avoid negative impacts on trees during construction of 42nd Place North. 16. The use of Hennepin Parks property for any parking, soil storage or other construction related uses is prohibited. Adopted by the City Council on April 19, 1993. (res/cc/92112.fp.sc) r
