RESOLUTION 93-211
APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAT/PLAN,
CONDITIONAL USE PERMIT AND SUBDIVISION ORDINANCE VARIANCE FOR JANCO INC.
LOCATED NORTHEAST OF COUNTY ROAD 9 AND NORTHWEST BOULEVARD (92112)
WHEREAS, Janco Inc. has requested approval of a Residential Planned Unit
Development Preliminary Plat/Plan for the development of 91 single family
detached lots on 42.2 acres, Conditional Use Permit and Subdivision Ordinance
Variance for property located northeast of County Road 9 ane Northwest
Boulevard; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, 3E IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the Residential
Planned Unit Development Preliminary Plat/Plan for the development of 91
single family detached lots on 42.2 acres, Conditional Use Permit and
Subdivision Ordinance Variance for Janco Inc. for property located northeast
of County Road 9 and Northwest Boulevard, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's
expense.
3. No building permits shall be issued until a contract has been awarded for
sewer and water.
5. Street names shall comply with the City Street Naming System.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
7. Rezoning shall be finalized with the filing of the Final Plat.
8. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
9. Final Plat mylars shall refer to RPUD 92-6.
10. Approved Swan Lake South Addition setbacks are:
a. 10 foot side yard setback
b. 35 foot front yard setback
c. 25 foot rear yard setback

11. Approved Courtyards of French Creek setbacks are:
a. 10 foot side yard setback to living areas, 6 foot side yard setback to
the garage side with a minimum 16 foot setback between structures
b. 35 foot front yard setback, 25 foot front yard setback to the garage;
35 foot front yard setback from County Road 9 to the garage and a 50
foot front yard setback from County Road 9 to living area.
c. 25 foot rear yard setback
12. The minimum lot size shall be 7,575 square feet.
13. Maximum lot coverage shall be 20 percent in Swan Lake South and 30 percent
in the Courtyards of French Creek, except that 31 percent lot coverage is
approved for Lots 1-5, Block 1, Courtyards of French Creek.
14. Compliance with the terms of City Council Resolution 89-439 regarding tree
preservation.
15. The proposed Planned Unit Development complies with the Conditional Use
Permit standards.
16. A variance is granted for a cul-de-sac length extension of 695 feet versus
the Subdivision Code limit of 500 feet for 42nd Avenue North.
17. An additional park trail outlot (Outlot D) shall be added in the vicinity
of Lot 9, Block 3, Swan Lake South Addition.
18. Park dedication requirements shall be fulfilled by the dedication of
park/trail land (Outlots A, B, C and D, Swan Lake South) and payment of
park fees at the time of final platting.
19. The developer shall construct the trails in Outlots A, B, and C Swan Lake
South per City standards. Financial reimbursement for the construction of
the trail will be determined at the time of construction. Construction
shall be complete prior to issuance of building permits on adjacent lots.
20. Approval by the City Council of the wetlands report submitted responsive
to the Wetlands Act of 1991.
21. The petitioner shall work in close coordination with the Hennepin Parks to
avoid negative impacts on trees during the construction of 42nd Place
North.
22. The use of Hennepin Park property for any parking, soil storage, or other
construction related uses is prohibited.
23. Submission of a Site Improvement Performance Agreement for completion of
the private landscaping and amenities in the Courtyard of French Creek.

24. Appropriate legal documents regarding Homeowner Association covenants and
restrictions for the Courtyards of French Creek, as approved by the City
Attorney, shall be filed with the Final Plat. The covenants and
restrictions shall specifically include maintenance responsibilities,
including all perimeter landscaping, and access related to the common
parking areas, driveways, and the outlot.
25. Access shall be limited to internal public roads and prohibited from
County Road 9.
26. A detailed landscaping and berming plan shall be submitted with the RPUD
Final Plat/Final Plan for the Courtyards of French Creek.
27. Screening shall be installed by the developer, as approved in advance by
the Director of Community Development, along the south property line of
PID 15-118-22-11-0021 prior to the opening of 42nd Place North for any
type of traffic. Said screening shall generally consist of spruce trees
of 12 feet height at planting located on 15 foot centers.
