HomeMy WebLinkAboutCity Council Resolution 1993-189CITY OF PLYMOUTH RESOLUTION 93- 189 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR ARGUS DEVELOPMENT, INC. FOR "EAGLEWOOD ADDITION" LOCATED NORTHEAST OF COUNTY ROAD 9 AND GOLDENROD LANE NORTH (92110) (RPUD 92-5) WHEREAS, the City Council has approved the Final Plat and Development Contract for Argus Development, Inc. located northeast of County Road 9 and Goldenrod Lane North; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Park dedication current requirements shall be fulfilled by the dedication of 1.5 acres for park and park trail land (Outlots A and B). 4. The deeds for Outlots A and B shall be transferred to the City prior to filing the Plat with Hennepin County. 5. No Building Permits shall be issued until a Contract has been awarded for the construction of municipal sewer and water. 6. Removal of all dead or dying trees from the property at the owner's expense. 7. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 8. Approved setbacks are: a. 10 foot side yard setback b. 35 foot front yard setback C. 25 foot rear yard setback 9. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 10. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. • Resolution No. 92-189 Page Two, File 92110 11. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 92-5 per Section 9 of the Zoning Ordinance. 12. Access shall be limited to internal public roads and prohibited from Rockford Road (County Road 9). 13. The Development Contract as approved by the City Council shall be fully executed prior to release of the Final Plat. 14. Maximum lot coverage shall be 20 percent. 15. Variance is granted for cul-de-sac of 925 feet versus the Subdivision Code limit of 500 feet. 16. The developer shall construct the trails in Outlots A and B per City standards prior to the issuance of any building permits for Lot 1, Block 1, and Lot 12, Block 1; and Lot 1, Block 3. Financial reimbursement for construction of the trail will be determined at the time of construction. 17. Existing trees located along the rear property line of Lots 8-12, Block 1, shall be preserved. 18. Submission of a financial guarantee and Site Improvement Performance Agreement for completion of landscaping along County Road 9 in compliance with the detailed plan prior to issuance of any building permits for Lots 1-7, Block 3.
