RESOLUTION NO. 93- 173
AUTHORIZING THE VACATION OF A PORTION OF A DRAINAGE EASEMENT IN
LOT 6, BLOCK 2 - ZACHARY HILLS
WHEREAS, a petition was received to vacate a portion of a drainage easement in Lot 6,
Block 2 - Zachary Hills Addition; and
WHEREAS, a public hearing with respect to said vacation was scheduled for March 29,
1993 in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of March 29. 1993; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council did hold a public hearing on March 29, 1993 to inform any and all
interested parties relevant to the vacation of a portion of a drainage easement in Lot
6, Block 2 - Zachary Hills; and
WHEREAS, it was determined by the City Council that said easement is not needed for
public purposes.
NOW, THEREFORE. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA: That the following portion of a drainage easement in Lot 6, Block 2 -
Zachary Hills be vacated:
That part of Lot 6. Block 2, Zachary Hills being a part of the drainage
easement as dedicated in said plat described as follows: Beginning at a
i point on the northwesterly line of said Lot 6 distant 85.00 feet
northeasterly along said northwesterly line from the most westerly corner of
said Lot 6; thence South 67 degrees 17 minutes 53 seconds East, assumed
bearing, perpendicular to said northwesterly line 90.00 feet to the
southeasterly line of said Lot 6. thence North 22 degrees 42 minutes 07
seconds East along said southeasterly line 18.00 feet; thence North 72
degrees 17 minutes 53 seconds West 66.00 feet; thence North 83 degrees 56
minutes 15 seconds West 25.31 feet to said northwest line; thence South 22
degrees 42 minutes 07 seconds West along said northwesterly line 5.00 feet
to the point of beginning. Except the northwesterly 6.00 feet thereof.
Also except the southeasterly 6.00 feet thereof.
Adopted by the City Council on March 29, 1993.
