RESOLUTION 93- 166
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
GRAHAM LAND DEVELOPMENT COMPANY FOR "FORSTER PRESERVE" LOCATED AT 42ND AVENUE
NORTH AND EVERGREEN LANE (92090) (RPUD 92-4)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Graham Land Development Company for "Forster Preserve" located at 42nd
Avenue North and Evergreen Lane;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. The Ordinance rezoning the property shall be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
3. Payment of park dedication fees -in -lieu of dedication in accordance with
City Policy in effect at the time of filing of the Final Plat.
4. No building permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water.
5. Removal of all dead or dying trees from the property at the owner's
expense.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
7. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
8. No building permits to be issued until the Final Plat is filed and
recorded with Hennepin County.

9. The Final Plat mylars shall contain a statement noting that the plat is
part of the approved RPUD 92-4 per Section 9 of the Zoning Ordinance.
10. The Development Contract, as approved by the City Council, sh611 be fully
executed prior to release of the Final Plat.
11. Maximum lot coverage shall be 20 percent.
12. Compliance with the terms of City Council Resolution 89-439 regarding tree
preservation.
13. Approved setbacks are:
a. 10 foot side yard setback
b. 30 foot front yard setback
C. 25 foot rear yard setback
14. Minimum lot size at 10,800 square feet.
15. All wetlands mitigation features recommended by the report of Summit
Envirosolutions dated November 19, 1992 shall be referenced in the
Development Contract and subject to financial guarantee for compliance.
