RESOLUTION 93-164
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
LUNDGRN BROS. CONSTRUCTION COMPANY FOR "HEATHER RUN" LOCATED AT THE NORTHEAST
CORNER OF COUNTY ROAD 101 AND COUNTY ROAD 24 (92035) (RPUD 92-3)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Lundgren Bros. Construction Company for 36 lots of "Heather Run" located
at the northeast corner of County Road 101 and County Road 24;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. The Ordinance rezoning the property shall be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
3. Payment of park dedication fees -in -lieu of dedication with appropriate
credits in an amount determined according to verified acreage and paving
costs and according to the Dedication Policy in effect at the time of
filing of the Final Plat.
4. No building permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water.
5. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
6. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
7. No building permits to be issued until the Final Plat is filed and
recorded with Hennepin County.
8. Appropriate legal documents regarding Homeowner Association covenants and
restrictions, as approved by the City Attorney, shall be filed with the
Final Plat.
9. The Final Plat mylars shall contain a statement noting that the plat is
part of the approved RPUD 92-3 per Section 9 of the Zoning Ordinance.

10. Private driveway access shall be limited to internal public roads and
prohibited from County Road 24, County Road 101, and Medina Road.
11. Submission of a Site Improvement Performance Agreement for completion of
the private improvements in the common open space.
12. Approved setbacks and lot widths are:
a. 9 foot (living) and 6 foot (garage) side yard setback.
b. 35 foot front yard setback except that Lots 6, 7, and 11, Block 2,
and Lots 16, 17, 18, and 19, Block 3, shall have a 25 foot front yard
setback.
C. Lot width at the rear property line 15 feet.
d. Lot width at the front setback line 75 feet.
13. Minimum lot size is 10,000 square feet.
14. An easement to the Homeowners Association shall be provided -for all areas
bermed/landscaped on the Preliminary Plan (labeled "General Development
Plan"), and the HOA documents shall provide for perpetual HOA maintenance
of the easement areas.
