HomeMy WebLinkAboutCity Council Resolution 1993-021CITY OF PLYMOUTH REPLACES AND SUPERSEDES RESOLUTION NO. 90-35 AND THE ORIGINAL RESOLUTION 93-21 AMENDED RESOLUTION NO. 93-21 AUTHORIZING THE VACATION OF A PORTION OF 49TH AVENUE FORMERLY CREST VIEW DRIVE AND A PORTION OF WELLINGTON LANE FORMERLY HILLSIDE AVENUE IN SKYLINE HILLS - UNIT NO. 1 WHEREAS, a petition was received to vacate a portion of 4;'th Avenue, formerly Crest View Drive and a portion of Wellington Lane formerly Hillside Avenue in Skyline Hills - Unit No. 1; and WHEREAS, Hennepi:. County has requested the City of Plymouth to amend the original resolution vacating portion of said streets in lieu of subsequent proceedings; and WHEREAS, a public hearing :Pith respect to said vacation was scheduled for January 4, 1993 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of January 4, 1993; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on January 4, 1993, to inform any and all interested parties relevant to the vacation of a portion of 49th Avenue, formerly Crest View Drive and a portion of Wellington Lane formerly Hillside Avenue in Skyline Hills - Unit No. 1; and WHEREAS, it was determined by the City Council that said easements are not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following portions of 49th Avenue, formerly Crest View Drive and Wellington Lane formerly Hillside Avenue in Skyline Hills - Unit No. 1 be vacated: That part of 49th Avenue, formerly Crest View Drive, and that part of Wellington Lane, formerly Hillside Avenue, all as dedicated in the plat of Skyline Hills - Unit No. 1, which lies between the east line of said plat and the northwesterly prolongation of the southwesterly line of Block 3, in said plat. FURTHER, that said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same, to enter upon such way or portion thereof vacated to repair, replace, remove other attend thereto. FURTHER, subject to a drainage and utility easement over, under, and across that part of the north 6 feet of said 49th Avenue lying between the east line of said plat and the northwesterly prolongation of the southwesterly line of Block 3 in said plat, together with a drainage and utility easement over, under, and across that part of said 49th Avenue and that part of said Wellington Lane, all embraced within a strip, 10 feet in width, the westerly line of said strip being the northwesterly prolongation of the southwesterly line of said Block 3, which lies south of the south line of the north 6 feet of said 49th Avenue.
