RESOLUTION 93-5
APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAT/PLAN,
CONDITIONAL USE PERMIT AND VARIANCE FOR ARGUS DEVELOPMENT, INC. LOCATED
NORTHEAST OF COUNTY ROAD 9 AND GOLDENROD LANE NORTH (92110)
WHEREAS, Argus Development, Inc. has requested approval of a Residential
Planned Unit Development Preliminary Plat/Plan for the development of 30
single family detached lots on 14.96 acres, Conditional Use Permit and
Variance for property located northeast of County Road 9 and Goldenrod Lane
North; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the Residential
Planned Unit Development Preliminary Plat/Plan for the development of 30
single family detached lots on 15 acres, Conditional Use Permit and Variance
for Argus Development, Inc. for property located northeast of County Road 9
and Goldenrod Lane North, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's
expense.
3. No building permits shall be issued until a contract has been awarded for
sewer and water.
5. Street names shall comply with the City Street Naming System.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
7. Rezoning shall be finalized with the filing of the Final Plat.
8. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
9. Final Plat mylars shall refer to RPUD 92-5.

10. Approved setbacks are:
a. 10 foot side yard setback
b. 35 foot front yard setback
c. 25 foot rear yard setback
11. The minimum lot size shal be 11,900 square feet
12. Maximum lot coverage shall be 20 percent.
13. Compliance with the terms of City Council Resolution 89-439 regarding tree
preservation.
14. The proposed Planned Unit Development complies with the Conditional Use
Permit standards.
15. Approval by the City Council of the Wetlands Mitigation Plan submitted
responsive to the Wetlands Act of 1991.
16. All wetlands mitigation features recommended by the report of Summit
Envirosolutions dated December 1, 1992 shall be referenced in the
Development Contract and subject to financial guarantee for compliance.
17. A variance is granted for a cul-de-sac length of 925 feet versus the
Subdivision Code limit of 500 feet.
18. Park dedication requirements shall be fulfilled by the dedication of 1.5
acres for park and park/trail land (Outlots A and B).
19. The developer shall construct the trails in Outlots A and B per City
standards prior to the issuance of any building permits for Lots 1, Block
1, Lot 12, Block 1, and Lot 1, Block 3. Financial reimbursement for the
construction of the trail will be determined at the time of construction.
20. The existing trees located along the rear property line of lots 8 through
12, Block 1, shall be preserved.
21. Submission of a financial guarantee and Site Improvement Performance
Agreement for completion of the landscaping along County Road 9 in
compliance with a detailed plan to be submitted with the Final Plat prior
to the issuance of any building permits for Lots 1 through 7, Block 3.
