RESOLUTION 93- 1
APPROVING PRELIMINARY PLAT/GENERAL DEVELOPMENT PLAN AND SUBDIVISION CODE
VARIANCE FOR PLYMOUTH PARTNERS II FOR PLYMOUTH TECHNOLOGY PARK (91031)
WHEREAS, Plymouth Partners II has requested approval for a Preliminary
Plat/General Development Plan and Subdivision Code Variance for Plymouth
Technology Park, a plat for 4 lots and 3 outlots on 39.9 acres located at the
northwest corner of Interstate Highway 494 and West Schmidt Lake Road (49th
Avenue North); and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it hereby does approve the request by Plymouth
Partners II for a Preliminary Piat!General Development Plan and Subdivision
Code Variance for Plymouth Technology Park for 4 lots and 3 outlots located at
the northwest corner of Interstate Highway 494 and West Schmidt Lake Road
(49th Avenue North), subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's
expense.
3. No building permits shall be issued until a contract has been awarded for
public sewer, water, and streets.
4. Payment of park dedication fees -in -lieu of dedication in accordance with
the Dedication Policy in effect at the time of issuance of building
permits.
5. Street names shall comply with the City Street Naming System.
6. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.
7. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
8. Incorporation of tree protection provisions in the Final Plat and
Development Contract approval.
9. This approval is explicitly conditioned upon the compliance with
applicable requirements of the State Environmental Review Program as
follows:

a. This approval does not preclude the imposition of changes in the
project or of mitigation measures that would reduce or avoid
environmental impacts that are disclosed in the Environmental
Assessment Worksheet (EAW), comments received on the EAW, the
Environmental Impact Statement (EIS) if an EIS is prepared, and
comments received on the EIS.
b. This approval is conditioned upon the completion of the required
Environmental Review process in accordance with State Environmental
Quality Board rules rather than on a decision that an Environmental
Impact Statement is not necessary.
This approval does not preclude an ultimate decision by City or by
any other governmental unit to deny approval of the project pursuant
to Minnesota Statutes Section 1160.04, Subdivision 6 in the event
that an Environmental Impact Statement should reveal that the project
would be likely to cause pollution, impairment, or destruction of the
environment and that there is a "feasible and prudent" alternative to
the project.
10. A Variance is granted from Section 500.21 of the City Code (Subdivision
Ordinance) for the creation of a 6.8 acre parcel versus the Zoning
Ordinance minimum 20 acres in the FRD District based on the request
meeting the Variance criteria.
11. Approval of the General Development Plan is for general arrangement and
locational feasibility only. No approval is granted or implied with
respect to uses, Zoning or Subdivision Ordinance dimensional standards,
offstreet parking, public roadway access, or, compliance with
City/State/Federal statutes/codes/rules regarding site development or
environmental issues.
12. The labeling of "Future Interchange R.O.W." on the General Development
Plan is suggestive only. No commitment to construct such an interchange
is implied by General Development Plan approval.
