• Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota was held on the 18th day of December
1989. The following members were present: Mayor Schneider, Councilmembers
Vasiliou, Ricker, Zitur and Sisk '
The following members were absent: None
Councilmember Sisk introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 89-823
AUTHORIZING CONDEMNATION PROCEEDINGS
SCHMIDT LAKE ROAD CONSTRUCTION
CITY PROJECT NO. 705
WHEREAS, the City of Plymouth has undertaken City Project No. 705; and
WHEREAS, in order to construct the improvements certain permanent and temporary
easements are required; and
WHEREAS, the City Council finds it necessary, proper and expedient in the interests of
the public health, convenience and general welfare of the citizens of the City of
Plymouth for the City to acquire said easements; and
WHEREAS, the City Council finds that the construction schedule for said public project
makes it necessary to acquire title to and possession of the easement interests prior
to the filing of the final report of the condemnation commissioners to be appointed by
the district court; and
WHEREAS, the use of Minn. Stat. Sec. 117.042 (1988), so-called "Quick -Take" statute,
will enable the City to timely acquire the required lands;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA: That the City Attorney is hereby authorized to commence condemnation
proceedings utilizing said "Quick -Take" statute for City Project No. 705 for the
following described easements within the following described parcels:
DESCRIPTTON OF PROP.RTy: (PIN 12-118-22-23-0004)
The South 30 acres of that part of the South 1/2 of the Northwest 1/4 lying
West of the easterly 20 acres thereof, Section 12, Township 118, Range 22;
subject to a right-of-way two rods wide along the West side thereof, except
that part now platted as Blocks 1 and 2, Sunrise Hill.
A permanent easement 20 foot in width for public utility purposes over, under,
across and through that part of the above described property, the centerline
of which is described as follows: Commencing at the intersection of the South
line of the North 1/2 of the Southeast 1/4 of the Northwest 1/4 of said
' Section 12 with the centerline of Schmidt Lake Road as dedicated in the plat
of Zachary Heights, Hennepin County, MN; thence on an assumed bearing of South
33 degrees, 29 minutes, 43 seconds East along the Southeasterly extension of
Resolution No. 89- 823

said centerline 262.08 feet; thence Southeasterly 432.45 feet along a
tangential curve concave to the Northeast having a central angle of 25
degrees, 56 minutes, 47 seconds and a radius of 954.93 feet; thence North 60
degrees, 52 minutes, 34 seconds East, not tangent to said curve, 75.0 feet to
the point of beginning of the centerline to be described; thence South 60
degrees, 52 minutes, 34 seconds West, 150.0 feet and said centerline there
terminating.

A permanent easement 80 feet in width for public street and utility
purposes over, under, across, and through that part of the above described
property the centerline of w'-ich is described as follows: Beginning at the
intersection of the South line of the North 1/2 of the Southwest 1/4 of the
Northwest 1/4 of said Section 12 with the centerline of Schmidt Lake Road
as dedicated in the plat of Zachary Heights, Hennepin County, MN; thence
Southeasterly along the Southeasterly extension of said centerline 262.08
feet; thence Southeasterly 960.68 feet along a tangential curve concave to
the Northeast having a central angle of 57 degrees, 38 minutes, 26 seconds
and a radius of 954.93 feet from said centerline there terminating.

A permanent easement for drainage and ponding purposes over, under, across,
and through that part of the above described property described as follows:
Beginning at a point on the South line of the Northwest 1/4 of said Section
12, distant 135.00 feet East from the Southwest corner of the Southeast 1/4
of the Northwest 1/4 of said Section 12; thence South 88 degrees, 51
minutes, 51 seconds West, assumed bearing, along the South line of the
Northwest 1/4 of said Section 12, a distance of 164.00 feet; thence North
12 degrees, 51 minutes, 51 seconds East 121.00 feet; thence North 16
degrees, 08 minutes, 09 seconds West 93.00 feet; thence North 36 degrees,
51 minutes, 51 seconds East 71.00 feet; thence North 55 degrees, 51
minutes, 51 seconds East to the intersection with a line run parallel with
and distant 40.00 feet Southwesterly from the following described "Line A";
thence Southeasterly along said parallel line to the intersection with a
line bearing North 27 degrees, 21 minutes, 51 seconds East from the point
of beginning; thence South 27 degrees, 21 minutes, 51 seconds West to the
point of beginning.
"Line A" is described as follows: Beginning at the intersection of the
South line of the North 1/2 of the Southwest 1/4 of the Northwest 1/4 of
said Section 12, with the centerline of Schmidt Lake Road as dedicated in
the plat of Zachary Heights, Hennepin County, MN; thence Southeasterly
along the Southeasterly extension of said centerline 262.08 feet; thence
Southeasterly 960.68 feet along the tangential curve concave to the
Northeast having a central angle of 57 degrees, 38 minutes, 26 seconds and
a radius of 954.93 feet and said centerline there terminating.
The motion for the adoption of the foregoing Resolution was duly seconded by
CouncilMamhe Rirupr , and upon vote being taken thereon, the following voted

Whereupon the Resolution was declared duly passed and adopted.
