Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 18th day
of December 19_3_9 The following members were present:
Mayor Schneider, Councilmembers Vasiliou Ricker. Zitur and Sisk
The following members were absent: None
Councilmember Ricker introduced the following Resolution and
moved its adoption:
RESOLUTION 89-796
DENIAL OF LOT DIVISION/CONSOLIDATION AND VARIANCES FOR MARVIN H. ANDERSON
CONSTRUCTION COMPANY (89099)
WHEREAS, Marvin H. Anderson Construction Company has requested approval for
lot division/consolidation and variances to lot area and lot width of a
proposed parcel located at the southwest corner of 47th Avenue North and
Ithaca Lane; and,
WHEREAS, the Planning Commission has reviewed said requests and recommends
denial;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does deny the request for lot
division/consolidation and variances for Marvin H. Anderson Construction
Company for property located at the southwest corner of 47th Avenue North and
Ithaca Lane, based on the following findings:
1. There are no particular physical characteristics of this parcel creating a
hardship as distinguished from an inconvenience if the strict regulations
of the district are carried out.
2. The conditions upon which this petition for variances are based are not
unique to this parcel. Numerous parcels throughout the City are "corner
lots" requiring specific house designs to fit the special setback
requirements.
The motion for adoption of the foregoing Resolution was duly seconded
by Mayor Schneider , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Schneider, Councilmembers
Ricker and Zitur
The following voted against or abstained Councilmembers Sisk and Vasiliou
Whereupon the Resolution was declared duly passed and adopted
