HomeMy WebLinkAboutCity Council Resolution 1989-793CITY OF PLYMOUTH 0 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 18th day of _ December 1989. The following members were present: Mayor Schneider Councilmembers Vasilinu , Ricker. Zitur and Sisk The following members were absent: Wnnp Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 89-793 AUTHORIZING THE VACATION OF A PORTION OF FIRST AVENUE WITHIN KINGSWOOD FARM ADDITION WHEREAS, a petition was received to vacate a portion of First Avenue within Kingswood Farm Add,cion; and WHEREAS, a public hearing with respect to said vacation was scheduled for December 18, 1989, in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of December 18, 1989; and WHEREAS, the Council did hold a public hearing on December 18, 1989, to inform any and all interested parties relevant to the vacation of a portion of First Avenue within 10 Kingswood Farm Addition; and WHEREAS, it was determined by the City Council that said street right-of-way is no longer needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following street be vacated: That part of First Avenue North as originally laid out and platted in the plat of Kingswood Farm between County Highway 101 and Kimberly Lane. FURTHER, the City shall reserve a drainage and utility easement for the existing watermain over the north 15 feet of said vacated street. FURTHER, that said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same, to enter upon such way or portion thereof vacated to repair, replace, remove otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by _Councilmember 7itur and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou. Ricker. Zitur and Sisk , The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
