HomeMy WebLinkAboutCity Council Resolution 1989-773CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 20th day of November, 19 89 The following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION 89-773 SETTING CONDITIONS TO BE MET PRIOR TO FILING AND REGARDING LOT DIVISION/LOT CONSOLIDATION AND VARIANCES FOR ROBERT K. WALLACE FOR PROPERTY LOCATED AT 17920 20TH AVENUE NORTH (89091) WHEREAS, the City Council has approved a lot division/lot consolidation for Robert K. Wallace for property located at 17920 20th Avenue North; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does direct the following conditions to be met prior to filing of the lot division/lot consolidation for Robert K. Wallace for property located at 17920 20th Avenue North, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing open storm water drainage facilities. 3. No building permit for the proposed garage to be issued until the division/consolidation is filed with Hennepin County. 4. Submittal of all necessary utility easements prior to filing with Hennepin County. 5. A variance is approved from the standards for the Shoreland Management District of the Zoning ordinance to permit creation of a parcel of less than 20,000 square feet on the basis that the new lot is marginally larger than the existing nonconforming lot it will replace, and the Ordinance variance criteria are met. 6. Variances are approved for front yard setback of 28 feet (35 -foot Ordinance standard); side yard setback to the west of 6 feet (15 -foot Ordinance standard); and rear yard setback of 12 feet (25 -foot Ordinance standard) based on compliance with the Zoning Ordinance standards for variance approval. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou. Ricker. Zitur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
