HomeMy WebLinkAboutCity Council Resolution 1989-764CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 20th day of November , 1989. The following members were present: , Mayor Schneider, Councilmembers Vasiliou, Ricker. Zitur and Sisk , The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 89-764 REQUEST FOR PAYMENT NO. 6 AND FINAL DEEP WELL NO. 10 - PUMPING FACILITIES CITY PROJECT NO. 814 WHEREAS, the City of Plymouth as owner and ABE Construction Company, as contractor, have entered into an agreement for Deep Well No. 10, Pumping Facilities, City Project No. 814, said agreement being dated October 28, 1988; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $108,120, change orders were approved in the amount of $910, and the value of the work to date is $109,030. 2. That the work performed by the Contractor for Deep Well No. 10, Pumping Facilities and certified to the Council by the engineer as acceptable, being the same, is hereby released from the contract except as to the conditions of the performance bond, any 4knd all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 6 and Final in the amount of $5,451.50 to ABE Construction Company for Deep Well No. 10, Pumping Facilities is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by ;ouncilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou.Ricker- , The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
