HomeMy WebLinkAboutCity Council Resolution 1989-758CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 20th day of November , 1989. The following members were present: Mayor Schneider- Councilmembers , Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Councilmember Sisk adoption: introduced the following Resolution and moved its RESOLUTION NO. 89- 758 REIMBURSING DEVELOPER FOR REQUIRED WATERMAIN CONSTRUCTION HARBOR PLACE ADDITION (87124) WHEREAS, the City of Plymouth and Hans Hagen Homes, Inc. have entered into a development contract dated January 3, 1989 for the development of Harbor Place Addition; and WHEREAS, as part of this development the developer was required to construct a 16 inch watermain in the Harbor Place Addition in order to conform with the City of Plymouth's overall Water Distribution Plan; and WHEREAS, the developer installed the required 16 inch watermain in 4th Avenue North and Glacier Lane within Harbor Place; and 10 WHEREAS, it is the policy of the City of Plymouth to reimburse developers for required watermain construction as provided for in the development contract; and WHEREAS, this amount to $34,893.60 including engineering fees. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That tho developer, Hans Hagen Homes, Inc., are to be reimbursed in the amount of $34,893.60 for the required 16 inch watermain construction based on the alignment in the construction plans and in accordance with Section 3.3 in the development contract. BE IT FURTHER RESOLVED that the funds be allocated from the Trunk Water Fund. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Zitur and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider,Councilmembers Vasiliou, Ricker, Zitur and Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
