Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 6th day of
Nnuamhar , 1989. The following members were present: ,
Mayor Schneider, Councilmembers Vasiliou, Ricker and Zitur
The following members were absent: Councilmember Sisk
Councilmember Vasiliou introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 89-715
REQUEST FOR PAYMENT NO. 3 AND FINAL
1988 STREET IMPROVEMENTS
PROJECT NO'S 517, 720, 813, AND 831
WHEREAS, the City of Plymouth as owner and Bury and Carlson, Inc., as
contractor, have entered into an agreement for the 1988 Street Improvement
Project, City Project No's 517, 720, 813, and 831, said agreement being dated
August 9, 1988; and
WHEREAS, the Engineer, Bonestroo, Rosene, Anderlik and Associates, Inc., has
certified his acceptance of the work and his approval of the final request for
payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $186,966.85 and the
value of the work to date is $168,061.70.
2. That the work performed by the Contractor for the 1988
Street Improvement Project and certified to the Council by
the engineer as acceptable, being the same, is hereby
released from the contract except as to the conditions of
the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after
final payment.
3. Request for Payment No. 3 and Final in the amount of
$19,326.36 to Bury and Carlson, Inc. for 1988 Street
Improvements is hereby approved and the City Finance
Director is hereby authorized and directed to pay the same
forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
faunrilmamh r Zitur , and upon vote being taken thereon, the following
voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou,
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
