HomeMy WebLinkAboutCity Council Resolution 1989-714CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 6th day of Novemher , 1989. The following members were present: Mxvor Schneider, Councilmembers Vasiliou, Ricker and Zitur ' The following members were absent: Councilmember Sisk Cnnneilmomher locker introduced the following Resolution and moved its adoption: RESOLUTION NO. 89- 714 REQUEST FOR PAYMENT NO. 4 AND FINAL PLYMOUTH CREEK PARK - PARKING LOT PROJECT NO. 910 WHEREAS, the City of Plymouth as owner and Bury and Carlson, Inc., as contractor, have entered into an agreement for Plymouth Creek Park - Parking Lot Improvements, City Project No. 910, said agreement being dated April 28, 1989; and WHEREAS, the Engineer Bonestroo, Rosene, Anderlik and Associates, Inc., has certified his acceptance of the work and his approval of the final request for payment. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: I. That the original contract amount was $67,839 and the value of the work to date is $70,040.66. 2. That the work performed by the Contractor for Plymouth Creek Park - Parking Lot Improvements and certified to the Council by the engineer as acceptable, being the same, is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 4 and Final in the amount of $4,327.58 to Bury and Carlson, Inc. for Plymouth Creek Park - Parking Lot Improvements is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by r-nuncilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: _Mayor Schneider. Councilmembers Vasiliou, Ricker and Zitus ' The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
