Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota was held on the 6th day of November
1989. The following members were ;resent: Mayor Schneider, Councilmembers Vasiliou
Ricker, Zitur and Sisk
The following members were absent: None
Mayor Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 89- 707
RESOLUTION AWARDING BID
WEST MEDICINE LAKE DRIVE TRUNK UTILITIES
CITY PROJECT NO. 905
WHEREAS, pursuant to an advertisement for bids for the West Medicine Lake Drive Trunk
Utilities Project, bids were received, opened and tabulated according to law, and the
following bids were received complying with the advertisement:

WHEREAS, it appears that Northdale Construction Company, Inc. of Rogers, MN is the
lowest responsible bidder, complying with the minimum specifications.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. The Mayor and City Clerk are hereby authorized and directed to enter
into the attached contract with Northdale Construction Company, Inc.
of Rogers, MN, in the name of the City of Plymouth for the
construction of West Medicine Lake Drive Trunk Utilities according to
the plans and specifications therefore approved by the City Council
and on file in the office of the City Clerk in the amount of the low
bid of $269,895.50.
2. The City Clerk is hereby authorized and directed to return forthwith
to all bidders the deposits made with their bids, except that the
deposits of the successful bidder and the next lowest bidder shall be
retained until a contract has been signed.

3. The bid award is subject to Northdale Construction waiving any and all
claims for damages arising out of the City of Plymouth's failure to
complete the environmental review process so that the sanitary sewer
can be constructed. Northdale Construction Company and the City shall
enter into an appropriate change order reflecting this waiver.
The motion for the adoption of the foregoing Resolution was duly seconded by
— Coungilmember Sisk , and upon vote being taken thereon, the following voted
in favor thereof: Maynr Sehneider, Councilmembera Ricker, Zitur and Sisk
The foEnvving voted against or abstained: Councilmember Vasiliou
Whereupon the Resolution was declared duly passed and adopted.
