HomeMy WebLinkAboutCity Council Resolution 1989-695CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular _ meeting of the City Council of the City of Plymouth, Minnesota, was held on the 6th day of Novemhen 19_U_ The following members were present: Mayor Schneider. Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members ware absent: None Mayor Schneider introduced the following Resolution and moved its adoption: RESOLUTION 89-695 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO RPUD FINAL PLAN/PLAT FOR GRAHAM DEVELOPMENT FOR HERITAGE WOODS ESTATES SECOND ADDITION (RPUD 88-5) (89087) WHEREAS, the City Council has approved the RPUD Final Plan/Plat and Development Contract for Heritage Woods Estates Second Addition as requested by Graham Development; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said RPUD Final Plan/Plat for Heritage Woods Estates Second Addition: 1. Compliance with the City Engineer's Memorandum, provided that the requirements of Items 24P and 24Q shall be changed to require temporary road easements and construction across Lot 20, Block 2 and Lot 11, Block 4; asphalt curb for the road by Lot 11; and installation of permanent curb and gutter by the developer when the temporary road is no longer needed. Further, no building permit shall be issued for Lot 20, Block 2 until the temporary street connection is removed after the completion of Northwest Boulevard from County Road 9 to County Road 10. 2. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 3. Removal of all dead or dying trees from the property at the owner's expense. 4. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 5. Street names shall comply with the City Street Naming System. 6. Rezoning shall be finalized with the filing of the Final Plat. 7. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 8. Appropriate legal documents regarding Homeowner Association covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 88-5 per Section 9 of the Zoning Ordinance. 10. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. 11. Minimum yard setbacks shall be 30 feet for the front yards, 10 feet (living side) and 5 feet (garage side) for the side yards and 30 feet for the rear yard. All set backs along Northwest Boulevard shall be 50 feet. 12. The Developer will provide copies of the current overall PUD Plan and its current conditions as an addendum to their purchase agreement. 13. Subsequent phases shall be subject to Ordinance provisions for Plan and Plat applications for the review and approval. 14. Private drive access shall be limited to internal public roads and restricted from Northwest Boulevard and West Medicine Lake Drive. 15. The design of proposed private open space areas including tot lots is specified on the Landscape Plan. The approved improvements and equipment shall be installed prior to issuance of building permits for homes on the adjacent lots. All Landscape Plan improvements shall be secured and guaranteed with a Site Improvement Performance Agreement and financial guarantee. 16. Signs 4 feet by 8 feet that show the approved development, including future County Road 61, shall be erected at the major entrances to the development. 17. The developer shall comply with those provisions of City Council Resolution No. 89-439 that apply. 18. Landscaping of the transition area along the entire south property line shall be consistent with the plan dated as received by the City October 31, 1989. Transition landscaping shall be secured and guaranteed with a Site Improvement Performance Agreement and financial guarantee. All landscape materials shall be installed prior to issuance of building permits on the lots on which the improvements are to be located (Lots 1- 11, Block 4). 19. Payment of park dedication fees -in -lieu of dedication in accordance with Dedication Policy in effect at the time of filing of the Final Plat with Hennepin County. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Ricker, zitur and Sisk The following voted against or abstained Nnne Whereupon the Resolution was declared duly passed and adopted.
