Ricker. itur and Si ak The following members were absent: None Cntjnrilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION 89- 693 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO RPUD FINAL PLAT AND DEVELOPMENT CONTRACT FOR HOST DEVELOPMENT/AL STORE FOR HERITAGE RIDGE PLAT TWO LOCATED SOUTH OF WEST MEDICINE LAKE DRIVE AND NORTHWEST BOULEVARD (89036) WHEREAS, the City Council has approved the Final Plat and Development Contract as requested by Host Development/A1 Stobbe for Heritage Ridge Plat Two; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a contract has been awarded for sewer and water, and the MPCA Permit issued. 4. No Building Permits shall be issued until the Final Plat has been filed and recorded at Hennepin County. 5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. Rezoning shall be finalized with filing of the Final Plat. 7. Final Plat mylars shall refer to RPUD No. 87-2. (see next page) RESOLUTION NO. 89-693 Page Two File 89036 8. Minimum front yard setbacks shall be 35 feet except for those lots along County Road 61 which shall have a minimum 50 foot setback to County Road 61; minimum side yard setbacks shall be 10 feet; and minimum rear yard setbacks shall be 25 feet; maximum lot coverage by structures shall be 20 percent for all lots. 9. Access shall be limited to internal public roads and restricted from Northwest Boulevard and West Medicine Lake Drive. 10. Easements shall be provided over all affected lots for the construction and location of the project signs, fencing and landscaping. Appropriate legal documents shall be provided for the City Attorney's approval to be recorded with the Fina V Plat. No Building Permits shall be issued for the affected lots prior to evidence being submitted that the easements and Homeowner's Association documents have been recorded at Hennepin County. 11. All signage must comply with the minimum ordinance requirements for setbacks and size. 12. The Developer will provide copies of the current overall PUD Plan and its current conditions as an addendum to their purchase agreement. 13. Subsequent phases shall be subject to Ordinance provisions for Plan and Plat applications for the review and approval. 14. The park dedication requirement was satisfied with the Heritage Ridge Addition. 15. Appropriate legal documents regarding Homeowner Association documents, covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat. These shall include ownership and maintenance responsibilities for project signs, fencing, landscaping and private open space (Outlot A). The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: _Mayor Schneider, councilmembers Vasiliou, Ricker, Zitur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
