Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 16th day
of October, 19&2_ The following members were present:

owing members were absent:
None
cauncilmember Zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 89-641
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
A. J. POPPELAARS FOR PONDEROSA WOODS LOCATED AT THE INTERSECTION OF 18TH
AVENUE NORTH AND IVES LANE (88139)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for A. J. Poppelaars for Ponderosa Woods located at the Intersection of 18th
Avenue North and Ives Lane;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of A.
J. Poppelaars for Ponderosa Woods located at the Intersection of 18th Avenue
North and Ives Lane subject to the following conditions to be met, prior to
recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. The Ordinance rezoning the property shall be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
3. Payment of park dedication fees -in -lieu of dedication in accordance with
City Policy in effect at the time of filing the Final Plat.
4. No Building Permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water, and the MPCA Permit issued.
5. Removal of all dead or dying trees from the property at the owner's
expense.
6. Minimum yard setbacks shall be 35 feet for the front yards, 15 feet for
the side yards and 25 feet for the rear yard.
7. Compliance with Policy Resolution No. 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.

8. Street names shall comply with the City Street Naming System.
9. No Building Permits to be issued until the Final Plat is filed and
recorded with Hennepin County.
10. Private drive access shall be limited to internal public roads and
restricted from Vicksburg Lane.
11. Existing fence shall be removed where in conflict with the Zoning
Ordinance based on the Final Plat.
12. The Developer shall comply with those provisions of City Council
Resolution 89-439 regarding tree preservation that apply.
13. The Development Contract as approved by the City Council shall be fully
executed prior to release of the Final Plat.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Sisk , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Schneider- COInrilmemhPrR
Vasiliou. Ricker. Zitur and Sisk
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
