HomeMy WebLinkAboutCity Council Resolution 1989-637I CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 16th- day of nc,t..h.r, , 19_&g_ The following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Mayor Schneider introduced the following Resolution and moved its adoption: RESOLUTION 89- 637 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT AND RELATED TO FINAL SITE PLAN PLAT FOR HARSTAD COMPANIES FOR LAKE CAMELOT VILLAS (89044) (RPUD 89-466) WHEREAS, the City Council has approved the Final Plat and Development Contract for Harstad Companies; and, WHEREAS, the City Council has approved the Final Site Plan for Lake Camelot Villas pursuant to the requirements of Sections 9 of the Zoning Ordinance and Resolution 89-466; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat and related to the Final Site Plan: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of filing of the Final Plat. 4. No Building Permits shall be issued until a Contract has been awarded for the construction of municipal sewer and water. 5 Removal of all dead or dying trees from the property at the owner's expense. 6. Compliance with Policy Resolution. No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Yard setbacks shall be per approved final plans. 8. Street names shall comply with the City Street Naming System. Final Plat mylars shall refer to RPUD No. 86-1. Minimum yard setbacks shall be 35 feet for the front yards, 10 feet for the side yards and 25 feet for the rear yard except as specifically provided for herein or by Resolution 86-256. 10. Appropriate legal documents regarding Homeowner Association documents, covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. 11. Private drive access shall be limited to internal public roads and restricted from County Road 47. 12. Maximum lot coverage shall be 20 percent consistent with the Zoning Ordinance definition of lot coverage. 13. Compliance with applicable provisions of the Environmental Assessment Worksheet. 14. The Developer shall comply with those provisions of City Council Resolution 89-439 on tree preservation that apply. 15. The Development Contract, including mortgagee waivers, as approved by the City Council shall be fully executed prior to release of the Final Plat. 16. Submission of required financial guarantee and site performance agreement for completion of site improvements. 17. The site improvements shall include enhanced landscaping which will maximize the transition buffer between the attached and detached units via berm or landscape, per plans to be approved by the Community Development Coordinator. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers The following voted against or abstained Nong Whereupon the Resolution was declared duly passed and adopted.
