HomeMy WebLinkAboutCity Council Resolution 1989-608CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 2nd day of October , 19_19_ The following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None t** Councilmember Zitur moved its adoption: introduced the following Resolution and RESOLUTION 89-608 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR JACK AND BETSY SWEDLUND FOR NORTHFORK LOCATED NORTH AND WEST OF THE INTERSECTION OF COUNTY ROAD 9 AND VICKSBURG LANE (89016) WHEREAS, the City Council has approved the Final Plat and Development Contract for Jack and Betsy Swedlund for Northfork located north and west of the intersection of County Road 9 and Vicksburg Lane; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Jack and Betsy Swedlund for Northfork located north and west of the intersection of County Road 9 and Vicksburg Lane subject to the following conditions to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of filing the Final Plat. 4. No Building Permits shall be issued until a contract has been awarded for the construction of municipal sewer and water, and the MPCA Permit issued. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Minimum yard setbacks shall be 35 feet for the front yards, 15 feet for the side yards and 25 feet for the rear yard. 7. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. (see next page) Resolution No. 89-608 Page Two File 89016 8. Street names shall comply with the City Street Naming System. 9. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 10. Private drive access shall be limited to internal public roads and restricted from Vicksburg Lane. 11. Existing fence shall be removed where in conflict with the Zoning Ordinance based on the Final Plat. 12= The Developer shall comply with those provisions of City Council Resolution 89-439 regarding tree preservation that apply. 13. The Development Contract as approved by the City Council shall be fully executed prior to release of the Final Plat. The motion for adoption of the foregoing Resolution was duly seconded by Coitneilmember Sisk , and upon vote being taken thereon, the 'allowing voted in favor thereof: mayor S hnPider_ Councilmembers Vasiliou Ricker.
