HomeMy WebLinkAboutCity Council Resolution 1989-602CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 2nd day of october , 19_2_, The following members were present: Mayor Schneider, councilmembers Vasiliou, Ricker, Zitur and risk The following members were absent: none Councilmember Zitur _ introduced the following Resolution and moved its adoption: RESOLUTION 89-602 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO RPUD FINAL PLAT/PLAN FOR ARADCO, INC./WALLY ANDERSON FOR PARKVIEW RIDGE (88018) (RPUD 83 - WHEREAS, the City Council has ap roved the RPUD Final Plat/Plan and Development Contract for ARADCO, Inc./Wally Anderson for Parkview Ridge; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does Line following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and paving costs and according to the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County. 4. No Building Permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Appropriate legal documents regarding Homeowner Association documents, covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. 8. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. (see next page) Resolution No. 89-602 File 88018 Page Two 9. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County Ordinance. 10. An access drive off County Road 9 shall be provided for construction vehicles, and all construction traffic shall access the property from County Road 9, until the first home is certified for occupancy. A barricade shall be constructed and maintained on 38th Avenue and on 39th Avenue at the plat boundary until the first dwelling is certified for occupancy. 11. No private drive access shall be permitted to County Road 9; all private drives shall be provided by internal public streets. 12. The private trails shall be built to City standards and shall be constructed prior to issuance of Building Permits for homes on lots adjacent to the trails; an exception may be made for Lots 1, 2 and 3, Block 3; and, Lots 3 and 4, Block 2, where model homes may be built but not occupied until the adjacent trails are constructed. 13. The design of proposed private open space areas including tot lots is specified. The approved improvements and equipment shall be installed prior to issuance of Building Permits for homes on the adjacent lots. 14. Outlots A and F shall be deeded to the City prior to filing the Final Plat with Hennepin County. 15. Minimumand setbacks shall be 30 feet for the front yards (detached and attached except Lots 1 and 2, Block 1 and Lots 8, 9, and 10, Block 3 which shall be 25 feet; 10 feet for the side yards and 15 feet for the rear yard. Structure setback to Outlot A on Lot 1, Block 2 shall be 30 feet. 16. The developer will provide copies of the current overall PUD Plan and its current conditions as an addendum to their Purchase Agreement. 17. Subsequent phases shall be subject to Ordinance provisions for Plan and Plat applications for the review and approval. 18. The Development Contract as approved by the City Council shall be fully executed prior to release of the Final Plat. The motion for adoption of the foregoing Resolution was duly seconded by rminrilmemh r Si Gk , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou Ricker. Zitur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
