Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 75rh day
of September , 19_JL2_ The following members were present:
Mayor Schne{der, Councilmembern Vast l io ni R_�pr, 7.1rtir and Rick
The following members were absent: None
Councilmember Zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 89-570
AUTHORIZING RELEASE OF SITE PERFORMANCE GUARANTEE FOR BURGER KING CORPORATION
(85003)
WHEREAS, a Site Plan for Burger King Corporation located at 10000 County Road
9 was approved under City Council Resolution 85-198; and,
WHEREAS, the developer submitted the required Site Performance Guarantee in
the form of a Bond in the amount of $120,000; and,
WHEREAS, the City Council under Resolution 86-660 authorized the reduction of
the Bond to $10,000; and,
WHEREAS, upon notice from the developer, City staff has inspected said site
and recommends release of the financial guarantee;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does authorize the release of
the Site Performance Bond No. 4725208 in the amount of $10,000, which was
submitted to guarantee site improvements for Burger King Corporation located
at 10000 County Road 9.
The motion for adaption of the foregoing Resolution was duly seconded
by. CounrilrW1mhPr S{clr , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou,
Ricker and Zitur
The following voted against or abstained Councilmember Sisk
Whereupon the Resolution was declared duly passed and adopted.
