HomeMy WebLinkAboutCity Council Resolution 1989-518CITY OF PLYMOUTH !► Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 11th day of September 1989. The following members were present: mayor Schneider- Councilmemhers Vasilinit , RiekAr__Zitur and Sink The following members were absent: Nene Cnimeilmemher S_tak introduced the following Resolution and moved its adoption: RESOLUTION NO. 89-518 AUTHORIZING CONDEMNATION PROCEEDINGS CO. RD. 18 FRONTAGE ROAD IMPROVEMENTS CITY PROJECT NO. 833 WHEREAS, the City of Plymouth has undertaken City Project No. 833; and WHEREAS, in order to construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council finds it necessary, proper and expedient in the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; and WHEREAS, the City Council finds that the construction schedule for said public project makes it necessary to acquire title to and possession of the easement interests prior to the filing of the final report of the condemnation commissioners to be appointed by the district court; and WHEREAS, the use of ,yap. Stat. Sec. 117.042 (1988), so-called "Quick -Take" statute, will enable the City to timely acquire the required lands; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the City Attorney is hereby authorized to commence condemnation proceedings utilizing said "Quick -Take" statute for City Project No. 833 for the following described easements within the following described parcels:: DES.RI TION OF PROPERT : (PIN 36-118-22-11-0007) That part of the North 200 feet of the South 230 feet of the East 525 feet of the Northeast Quarter of the Northeast Quarter of Section 36, Township 118, Range 22, Hennepin County, Minnesota lying westerly of the westerly line of County State Aid Highway No. 18, Plat 19 according to the recorded plat thereof. Resolution No. 89-518 Page Two DESCRIPTION OF EASEMENT: A perpetual easement for street and utility purposes over, under, across and through that part of the above described property lying easterly of the following described line: Commencing at the Southwest corner of the above described parcel; thence on an assumed bearing of South 89 degrees, 58 minutes, 22 seconds East, along the South line of the above described parcel, a distance of 314.17 feet to the point of beginning of the line to be described; thence Northeasterly 37.91 feet along a nontangential curve concave to the Northwest having a radius of 35 feet and a central angle of 61 degrees, 42 minutes, 06 seconds; the chord of said curve bears North 27 degrees, 30 minutes, 01 seconds East; thence Northwesterly 82.54 feet along a compound curve concave to the West, having a radius of 327.10 feet to said Westerly line of County State Aid Highway No. 18, Plat 19 and there terminating. and A perpetual easement for utility purposes over, under, across, and through that part of the above described property lying Southeasterly of a line run parallel with and distant 15 feet Northwesterly from the Southeasterly line of the above described property and its Northeasterly and Southwesterly extensions. and A temporary easement for construction purposes over, under, across, and through the East 15 feet of the South 180 feet of the above described property. and A temporary easement for construction purposes over, under, across, and through the South 17 feet of the above described property, except the West 287.0 feet thereof. The above described temporary easements shall expire on December 1, 1990, or upon completion of construction, whichever occurs first.
