HomeMy WebLinkAboutCity Council Resolution 1989-507CITY OF PLYMOUTH Pursuant to iue call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the _11th day of sept-pmhnr 19119-- The following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Councilmernber Sisk introduced the following Resolution and n.oved its adoption: RESOLUTION 89-507 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR NORTHLAND LAND COMPANY FOR "PARKER'S LAKE CORPORATE CENTER 3RD ADDITION" (89069) (MPUD 83-1) WHEREAS, the City Council has approved the Final Plat and Development Contract for Parker's Lake Corporate Center 3rd Addition as requested by Northland Land Company; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memwrandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 4. No yard setback variances are granted or implied. 5. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 6. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 7. The Final Plat mylars shall contain a statement noting that the plat is part of the approved MPUD per Section 9 of the Zoning Ordinance. 8. Access shall be limited to internal public roads except with respect to Niagara Lane, there shall be no more than 4 private accesses in aggregate over the entire frontage of the plat on Niagara Lane (2400 feet approx.). Subsequent plats and site plans which propose utilization of one of the curb cuts onto Niagara Lane shall include written confirmation as to the allocation of the remaining curb cuts including, if necessary, cross easements for shared drives between sites. One access has been used with the 2nd Addition. (see next page) RESOLUTION NO. 89-507 Page Two File 89069 9. The landscape/bene plan for the 40 foot transition area in the south and west borders of the plat dated September 20, 1988 is hereby approved. This landscape plan shall not constitute a substitute for landscaping and/or screening required for individual sites by City ordinance or policy. This landscape/berm plan is only a substitute for setback distance from structures in this plat to an adjoining residential district. The ordinance requires 75 feet and this landscape/berm plan shall when executed, substitute for 35 feet of that total. 10. Development shall comply with the Environmental Impact Statement approved for this development. 11. Development shall comply with applicable provisions of Resolution No's 87- 126, 84-261, 85-13, and 84-323, and the executed Development Contract for Parkers Lake Development Stage B: Parkers Lake North property. 12. The developer is to provide copies of the approved overall PUD plan and its conditions as an addendum to their purchase agreements. 13. Staging of the development shall be in accordance with utility availability as approved by the City Engineer. 14. The sign construction materials shall be presented by the petitioner and shall not be plastic; acrylic letters may be used on an industrial sign. 15. The City of Minneapolis shall acknowledge this development and its terms and conditions. 16. The signage facing Niagara Lane shall be 10 feet west of the trail as constructed.
