HomeMy WebLinkAboutCity Council Resolution 1989-503CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 11th day Of �Se teerl9$9__ The following members were present: Mavor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION 89-503 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT CONDITIONAL USE PERMIT AMENDMENT FOR HOWARD AND DESOLYN OLSON FOR CIMARRON PONDS (RPUD 76-3) (89066) WHEREAS, Howard and Desolyn Olson, have requested a Planned Unit Development Plan and Conditional Use Permit Amendment for property at 970 Xene Lane to allow the construction of a three season porch; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Howard and Desolyn Olson for a Residential Planned Unit Development Plan and Conditional Use Permit Amendment for property at 970 Xene Lane within the Cimarron Ponds PUD to construct a three season porch, pursuant to the following findings and conditions: 1. No other amendments or variances are granted or implied. 2. Submission of written verification that the Cimarron Ponds Homeowner Association has approved the building addition prior to issuance of building permits. 3. All applicable requirements of the City and State Building Codes shall be implemented and enforced; no code requirements are waived by this approval. 4. A finding is made that the proposed addition is within the ground cover footprint (structure plus concrete patio) approved with the original RPUD Plan. As such the degree of RPUD Plan amendment proposed is not of such scale as to alter the balance of Zoning Ordinance flexibility to PUD attributes found with the approved RPUD Plan. The motion for adoption of the foregoing Resolution was duly seconded by— _Cminr ilmPmher 2_itur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider. Councilmembers Vasiliou, Rirkwr_ 7itur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
