Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 11th day
of September 19_8_9_ The following members were present:
Mayor Schneider. Council_members Vasiliou, Ricker,Zitur and Sick
The following members were absent: None
Councilmember Ricker introduced the following Resolution and
moved its adoption:
RESOLUTION 89-501
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
PLYMOUTH CENTER 3RD ADDITION LOCATED IN THE SOUTHEAST QUADRANT OF PLYMOUTH
BOULEVARD AND 37TH AVENUE NORTH (89063)
WHEREAS, the City Council has approved the Final Plat for Plymouth Center 3rd
Addition;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. The Ordinance rezoning the property shall be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
2. Removal of all dead or dying trees from the property at the owner's
expense and compliance with Resolution 89-439 regarding tree preservation.
3. Compliance with Policy Resolution No. 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.
4. No yard setback variances are granted or implied.
5. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
6. No Building Permits to be issued until the Final Plat is filed and
recorded with Hennepin County.
7. The Final Plat mylars shall contain a statement noting that the plat is,
in part, part of the approved MPUD 78-2 and RPUD 84-5 per Section 9 of the
Zoning Ordinance.

8. Deferred parking shall be constructed at such time as a need is
identified. Parking on adjacent public streets shall constitute evidence
of need.
9. Compliance with the City Engineer's Memorandum.
10. Compliance with the Ordinance regarding the location of fire hydrants and
fire lanes.
The motion for adoption of the foregoing Resolution was duly seconded

Whereupon the Resolution was declared duly oassed and adopted.
