Pursuant to due call and notice thereof, a reeular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 11th day
of seRtembprl9_0 _ The following members were present:

The following members were absent: None
Councilmember zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 89-495
APPROVING AN AMENDED RPUD PLAN AND CONDITIONAL USE PERMIT TO THE DEERWOOD
ESTATES RPUD (RPUD 81-1) (89055)
WHEREAS, Donald Trotter has requested approval for an Amended RPUD
Preliminary Plan and Conditional Use Permit for a deck to encroach to within
.14 feet of the side property line at 11205 48th Avenue North; and,
WHEREAS, the deck was constructed without a Building Permit before the
applicant purchased the property; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called
Public Hearing;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the Amended RPUD
Preliminary Plan for Donald Trotter for a deck to encroach into the side yard
set back at 11205 48th Avaenue North subject to the following conditions:
1. No other amendments or variances are granted or implied.
2. All applicable requirements of the City and State Building Codes shall be
implemented and enforced; no code requirements are waived by this
approval. The applicant shall apply for a Building Permit and shall
ensure the construction meets or exceeds applicable structural standards.
3. The granting of the permit is responsive to criteria of the Zoning
Ordinance for Conditional Use Permits and PUD Plans; and the unique
circumstances related to the actions precedent to this application.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Vasiliou and upon vote being taken thereon,
the following voted in favor thereof: Mayor Schneider. Councilmembers Vasiliour
Ricker and 7Mtur
The following voted against or abstained Councilmember Sisk
Whereupon the Resolution was declared duly passed and adopted.
