Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 7th day
of Amt, 19 89 The following members were present:
Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk
The following members were absent: None
Councilmember Ricker introduced the following Resolution and
moved its adoption:
RESOLUTION 89-443
APPROVAL OF A SHORELAND MANAGEMENT SETBACK VARIANCE FOR THOMAS BALKINS
(07-01-89)
WHEREAS, Thomas Balkins, pursuant to Section 11, Subdivision f,, of the
Plymouth Zoning Ordinance has appealed the July 11, 1989, ruling of the Board
of Zoning Adjustments and Appeals' denying his request for a variance from the
minimum Shoreland Management setback at 2870 Evergreen Lane from 50 feet to 18
feet; and,
WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter at
a duly called Hearing; and,
WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning
Adjustments and Appeals, as well as the petitioner's application for the
variance;
NCW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the appeal of
Thomas Balkins for a variance for a maximum 32 -foot encroachment into the
required Shoreland Management setback based on the following findings:
I. Ordinance variance criteria have been met.
2. The situation is unique because the property is surrounded on three sides
by water.
The motion for &&option of the foregoing Resolution was duly seconded
by councilmember Vasiliou and upon vote being taken thereon,
the following voted in favor thereof: Councilmembers Ricker, Sisk and

Whereupon the Resolution was declared duly passed and adopted.
