Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 10th day of
July , 1989. The following members were present: ,
Mayor Schneider. Councilmembers Vasiliou, Ricker, Zitur and Sisk ,
The following members were absent: None
Mayor Schneider introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 89- 402
REQUEST FOR PAYMENT NO. 9 AND FINAL
WELL NO'S 8 AND 9 - PUMPING FACILITIES
PROJECT NO. 625
WHEREAS, the City of Plymouth as owner and New Mech Companies, Inc., as
contractor, have entered into an agreement for Well No's 8 and 9, Pumping
Facilities, City Project No. 625 said agreement being dated August 18, 1987;
and
WHEREAS, the Engineer has certified his acceptance of the work and his
approval of the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $257,700.00, one
change order deducting $247.23 was approved, and the value
of the work to date is $257,452.77.
2. That the work performed by the Contractor for Well No's 8
and 9, Pumping Facilities and certified to the Council by
the engineer as acceptable, being the same, is hereby
released from the contract except as to the conditions of
the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after
final payment.
3. Request for Payment No. 9 and Final in the amount of
$16,323.77 to New Mech Companies, Inc. for the Well No's 8
and 9, Pumping Facilities is hereby approved and the City
Finance Director is hereby authorized and directed to pay
the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Sisk , and upon vote being taken thereon, the following
voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Ricker, ,
.t tur and Sisk
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
