Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the loth day
of July , 19-L9— The following members were present:
Mayor Schneider, Councilmembers Vasiliou, Ricker. Zitur and Sisk
The followi►ig members were absent: None
Councilmember Sisk introduced the following Resolution and
moved its adoption:
RESOLUTION 89- 373
DENYING A CONDITIONAL USE PERMIT FOR STUART ERICKSON FOR A CLASS II RESTAURANT
IN THE I-1 ZONE AT 14505 21ST AVENUE NORTH (89042)
WHEREAS, Stuart Erickson has requested a Conditional Use Permit for a Class II
Restaurant (Subway Sandwich) in the I-1 District located at 14505 21st Avenue
North; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends denial.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does deny the request of Stuart
Erickson for a Conditional Use Permit for a Class II Restaurant in the I-1
Zone at 14505 21st Avenue North, subject to the following findings:
I. The establishment and operation of the conditional use will be
detrimental to the public safety in comfort. Specifically, proposed use
will increase the nonresident traffic and parking demands on the site in
the intensity for which it was designed.
2. The conditional use will be injurious to use and adjoinment of other
property in the immediate vicinity, specifically the residential
properties located immediately to the south and the balance of the
industrial properties located adjacent to the site.
3. The establishment of the conditional use will impede the normal and
orderly development and improvement of the surrounding property where
uses permitted in that district, specifically the residential district
located immediately to the south of the site.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Ricker and upon vote being taken thereon,
the following voted in favor thereof: Mayor Schneider, Counri1mgmbprR Vasiliou,
Ricker. Zitur and Sisk
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
