HomeMy WebLinkAboutCity Council Resolution 1989-367CITY OF PLYMOUTH Pursuant to due c?'1 and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the loth day of July , 19 89 The following members were present: Mayor Schneider, Councilmembers Vasiliot, Ricker, Zitur and Sisk The following members were absent: None Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION 89- 367 DENYING A CONDITIONAL USE PERMIT FOR RUDOLPH MARTI FOR A CLASS II RESTAURANT (DOMINO'S PIZZA) AT 1115 VICKSBURG LANE (89032) WHEREAS, Rudolph Marti has requested a Conditional Use Permit for a Class II Restaurant to operate a Domino's Pizza located at 1115 Vicksburg Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends denial; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request for Rudolph Marti for a Conditional Use Permit for a Class II Restaurant to operate a Domino's Pizza located at 1115 Vicksburg Lane, subject to the following findings: 1. The operation of the conditional use will be detrimental to the public safety, particular traffic safety related to turning movements on Vicksburg Lane. 2. The conditional use will be injurious to the use and enjoyment of other property in the immediate vicinity, specifically residences to the north, and other tenants of the Vicksburg Plaza. 3. The establishment of the conditional use will impede the normal and orderly development of the balance of the Vicksburg Plaza Center. 4. Traffic congestion will not be minimized sufficiently on the public streets by measures taken to provide ingress, egress and parking on the site for this proposed use type. The motion for ad(,Vtion of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou. Ricker. Zitur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
