HomeMy WebLinkAboutCity Council Resolution 1989-346CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 19th day of June , 19_ The following members were present: Mayor Schneider Councilmembers Vasiliou, Zitur and Sisk The following members were absent: Councilmember Ricker you--zilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION 89-346 RESOLUTION REQUESTING HEARING TO BE CONDUCTED FOR THE PURPOSE OF CONSIDERING AN AMENDMENT TO THE METROPOLITAN COUNCIL SYSTEM'S STATEMENT PERTAINING TO LOCATION OF METROPOLITAN URBAN SERVICE AREA WHEREAS, the City has been informed by the Metropolitan Council that it disagrees with the City on the location of the Metropolitan Urban Service Area (MUSA) line; WHEREAS, by letter dated May 10, 1989, the City Manager informed the Metropolitan Council of the City's position regarding the location of the MUSA line. WHEREAS, Minnesota Statutes Section 473.857 states that if a local unit of government and the Metropolitan Council are unable to resolve disagreements over the content of a system statement, the local governmental unit may request a hearing to be conducted by the advisory committee or by the state office of administrative hearings for the purpose of considering amendments to the system statement; WHEREAS, by a letter dated June 13, 1989, the City. Manager requested a hearing to resolve the disagreement between the City and Metropolitan Council; NOW, THEREFORE, be it resolved by the City Council of the City of Plymouth as follows: 1. A hearing pursuant to Minnesota Statues Section 473.857 is hereby requested and the City Council ratifies the request for such a hearing contained in the City Manager's letter dated June 13, 1989, to Steven Keefe, Chairman of the Metropolitan Council. 2. The City proposes that the Metropolitan Council's 1988 System's statement be amended so that the location of the MUSA line to changed to coincide with the location of the MUSA line as set forth in the City's comprehensive plan approved by the Metropolitan Council on December 23, 1982, under Resolution No. 82-223. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: mayor Schneider. Councilmembers Vasiliou. Zitur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
