HomeMy WebLinkAboutCity Council Resolution 1989-333CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 19th day of June , 1989. The following members were present: Mayor Schneider, Councilmembers Vasiliou , Zitur and Sisk _ The following members were absent: Councilmember Ricker Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 89-333 AUTHORIZING CONDEMNATION PROCEEDINGS HARBOR LANE STORM SEWER AND STREET IMPROVEMENTS CITY PROJECT NO. 912 WHEREAS, the City of Plymouth has undertaken City Project No. 912; and WHEREAS, in order to construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council finds it necessary, proper and expedient in the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; and WHEREAS, the City Council finds that the construction schedule for said public project makes it necessary to acquire title to and possession of the easement interests prior to the filing of the final report of the condemnation commissioners to be appointed by the district court; and WHEREAS, the use of Mim. Stat. Sec. 117.042 (1988), so-called "Quick -Take" statute, will enable the City to timely acquire the required lands; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the City Attorney is hereby authorized to commence condemnation proceedings utilizing said "Quick -Take" statute for City Project No. 912 for the following described easements within the following described parcels: DESCRIPTION OF PROPERTY: (PIN 33-118-22-14-0019) Lot 6, Block 1 Glen Grove Acres Hennepin County, Minnesota according to the recorded plat thereof. A perpetual easement for public street and utility purposes over, under, across, and through the west ten feet of the above described parcel together with a perpetual easement 20 feet in width for public utility purposes over, under, across, and through said Lot 6. The centerline of said easement is described as beginning at the southwest corner of said Lot 6; thence northeasterly at an angle to the right of 29 degrees, 00 minutes as measured from the west line of said Lot 6, a distance of 55 feet and said centerline there terminating. (PIN 33-118-22-14-0020) Lot 7, Block 1 Glen Grove Acres Hennepin County, Minnesota according to the recorded plat thereof. Resolution No. 88-333 Page Two DESCRIPTION OF EASEMENT: A perpetual easement for public street and utility purposes over, under, across, and through the west ten feet of the above described parcel. DESCRIPTION OF PROPERTY: (PIN 33-118-22-44-0007) The north 210.5 feet of Lot 17, Block 1 Glen Grove Acres Hennepin County, Minnesota according to the recorded plat thereof. DESCRIPTION OF EASEMENT: A perpetual easement for public street and utility purposes over, under, across, and through that part of the above described parcel lying westerly of the following described line: Commencing at the northwest corner of said Lot 17; thence on an assumed bearing of south 89 degrees, 59 minutes, 25 seconds east along the north line thereof a distance of 22.67 feet to the point of beginning of the line to be described; thence southerly 77.11 feet along a nontangential curve concave to the east having a radius of 229.49 feet, a central angle of 19 degrees, 15 minutes, 06 seconds, and a cord bearing of south 10 degrees, 36 minutes, 13 seconds west; thence south 89 degrees, 01 minutes. 20 seconds west and not tangent to said curve, a distance of 4.83 feet to the intersection with a line parallel with and distant 5.00 feet east from the west line of said Lot 17; thence southerly along said parallel line ' to the south line of the north 210.5 feet of said Lot 17 and said line there terminating. and A temporary easement for construction purposes over, under, across, and through the west 10 feet of the above described parcel. The above described temporary easement shall terminate on December 31, 1990 or upon completion of construction whichever occurs first. DESCRIPTION OF PROPERTY: (PIN 33-118-22-44-0008) That part of Lot 17, Block 1, Glen Grove Acres, Hennepin County, Minnesota, lying south of the north 210.5 feet and according to the recorded plat thereof. A perpetual easement for public street and utility purposes over, under, across, and through the west five feet of that part of the above described parcel lying north of the south 117 feet thereof and A temporary easement for construction purposes over, under, across, and through the east five feet of the west ten feet of the above described parcel. The above described temporary easement shall terminate on December 31, 1990, or upon completion of construction, whichever occurs first. Resolution No. 88-333 Page Three bDESCRIPTION OF PROPERTY: (PIN 33-118-22-44-0015) The north 83.8 feet of Lot 17, Block 2, Glen Grove Acres, Hennepin County, Minnesota, according to the recorded plat thereof. A perpetual easement for public street and utility purposes over, under, across, and through the east five feet of the above described parcel together with a perpetual easement for public utility purposes over, under, across, and through the north 40 feet of the east 15 feet of the above described parcel dnd A temporary easement for construction purposes over, under, across, and through the east i5 feet of the above described parcel. Said temporary construction easement shall terminate on December 31, 1990, or upon completion of construction, whichever occurs first. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmesiber Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Utur and Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
