The following members were present: Mayor Schneider, Councilmembers Vasiliou Zitur and Sisk , The following members were absent: Councilmemher Ricker Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 89- 326 DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT STREET LIGHTING - HERITAGE WOODS ESTATES ADDITION WHEREAS, a petition has been received from the developer requesting installation of ornamental residential street lighting in the Heritage Woods Estates Addition. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. A certain petition requesting the improvement of Heritage Woods Estates Addition by the installation of residential ornamental street lighting, filed with the City Council on June 19, 1989, is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformance to Minnesota Statutes Section 429.035. 2. The petition is signed by 100% of the affected property owners and they ha°ie waived their rights to public improvement and special assessrzynt hearings. 3. The petition is hereby referred to the City Engineer and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in conjunction with some other improvement and the estimated cost of the improvement as recommended. The motion for the adoption of the foregoing Resolution was duly seconded by Couneilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider Councilmembers Vasiliou. ZitLr , and Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
