Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 19th day
of June , 19_E9 The following members were present:
Mayor Schneider, Councilmembers Vasiliou, Zitur and Sisk
The following members were absent: Councilmember Ricker
Councilmember Sisk introduced the following Resolution and
moved its adoption:
RESOLUTION 89-320
DENIAL OF APPEAL OF ROGER SPEIKERS FROM BOARD OF ZONING ADJUSTMENTS AND
APPEALS' RULING (05-01-89)
WHEREAS, Roger Speikers, pursuant to Section 11, Subdivision C, of the
Plymouth Zoning Ordinance has appealed the May 9, 1989, ruling of the Board of
Zoning Adjustments and Appeals' denying his request for a variance from the
minimum front yard setback for a garage and workroom at 15820 9th Avenue North
from 50 feet to 35 feet; and,
WHEREAS, the Board of Zoning Adjustments and Appeals' considered the matter at
a duly called Hearing; and,
WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning
Adjustments and Appeals, as well as the petitioner's application for the
variance;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does deny the appeal by Roger
Speikers from the Board of Zoning Adjustments and Appeals' ruling for the
following reasons:
1. Standards for a variance have not been met.
2. The addition could be constructed within the Ordinance minimum yard set-
backs.
The motion for adoption of the foregoing Resolution was duly seconded
by M yor Schneider. , and upon vote being taken thereon,
the -following voted in favor thereof: Mayor Schneider, Councilmembers Zitur
and Sisk
The following voted against or abstained Councilmember Vasiliou
Whereupon the Resolution was declared duly passed and ac,opted.
