HomeMy WebLinkAboutCity Council Resolution 1989-249CITY OF PLYMOUTH okPursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the lst day of May , 1989. The following members were present: Mayor Schneider, Councilmembers Vasiliou , Ricker, Zitur and Sisk The following members were absent: None Councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION NO. 89-249 APPROVING CHkNGE ORDER NO. 2 AND FINAL COUNTY ROAD 101 AND FERNBROOK LANE TRAILS CITY PROJECT NO. 724 WHEREAS, the City of Plymouth as owner and Hardrives, Inc., as contractor, have entered into an agreement for the County Road 101 and Fernbrook Lane Trails Improvements, City Project No. 724 said agreement being dated July 29, 1987; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: ' 1. That the original contract amount was $124,165.25, change orders in the amount of $30,784 were approved, and the value of the work to date is $144,254.20. 2. That the work performed by the Contractor for County Road 101 and Fernbrook Lane Trails Improvements Project and certified to the Council by the engineer as acceptable, being the same, is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work before final payment. 3. Request for Payment No. 2 and Final in the amount of $7,212.71 to Hardrives, Inc. for the County Road 101 and Fernbrook Lane Trails 1%,provement Projects is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk , The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
