HomeMy WebLinkAboutCity Council Resolution 1989-246CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 1st day of MU , 1989. The following members were present: , Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk , The following members were absent: None . Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 89- 246 REIMBURSING DEVELOPER FOR REQUIRED TRAIL PAVING CONSTRUCTION FOX RUN 4TH ADDITION (88040) WHEREAS, the City of Plymouth and Lundgren Bros. Construction, Inc. have entered into a development con':act dated rune 6, 1988 for the development of Fox Run 4th Addition; and WHEREAS, as part of this development the developer was required to construct an 8' wide paved trRil along the northerly boundary of Fox Run 4th Addition in order to conform with the City of Plymouth's overall Trail System Plan; and WHEREAS, the developer installed and paved the required 8' wide trail along with the northerly boundary of Fox Run 4th Addition; and WHEREAS, it is the policy of the City of Plymouth to reimburse developers for the required trail paving construction as provided for in the development contract; and WHEREAS, this amounts to $8,700 for the paving costs. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the developer, Lundgren Bros. Construction, Inc. are to be reimbursed in rhe amount of $8,700 for the required trail paving construction based on the alignment in the approved conr.truction plans and in accordance with Sections 13.3 and 13.4 in the development contract. BE IT FURTHER RESOLVED that the funds be allocated from the Park Dedication Fund 218-218. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Zitur ,, and upon vote being taken thereon, the following voted in favor thereofMayor Schneider, Councilmembers Jasiliou, Ricker, Zirnr and Sisk The following voted agai,ist or abstained: None Whereupon the Resolution was declared duly passed and adopted.
