HomeMy WebLinkAboutCity Council Resolution 1989-245CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the Ist day of Mav , 1989. The following members were present: Mayor Schneider, Councilmembers , Vasilioil, Ricker, Zitur and Sisk The fo!Lowing members were absent: Non Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 89-245 REIMBURSING DEVELOPER FOR REQUIRED STREET CONSTRUCTION OF A 16 INCH WATERMAIN IN PARKERS LAKE NORTH 2ND ADDITION (87006) WHEREAS, the City of Plymouth and Northland Land Company have entered into a development contract dated July 29, 1987 for the development of Parkers Lake North 2nd Addition; and WHEREAS, as part of this development the developer was required to construct a 16 inch watermain between Vicksburg Lane and Niagara Lane on 18th Avenue through the Parkers Lake North 2nd Addition in order to conform with the City of Plymouth's Comprehensive Water Distribution Plan; and WHEREAS, the developer installed the required 16 inch watermain on 18th Avenue within Parkers Lake North 2nd Addition; and WHEREAS, it it the policy of the City of Plymouth to reimburse developers for required watermain construction as provided for in the development contract; and WHEREAS, this amounts to $56,451.42 for the required 16 inch watermain; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the developer, Northland Lan,' Company is to be reimbursed in the amount of $56,451.42 for required 16 inch watermain construction based on the alignment in the approved construction plans and in accordance with Section 3.3 in the development contract. BE IT FURTHER RESOLVED that the funds be allocated from the Trunk Water Fund. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, CniinnilmPmhers Vaai1inu,gic ars Z L"r , and Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
