Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 1st day
of May , 19 89 The following members were present:
Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk
The following members were absent: None
Councilmember Zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 89-239
APPROVING AN AMENDED MPUD CONDITIONAL USE PERMIT FOR TRAMMELL CROW COMPANY AND
AUTHORIZING A CLASS II RESTAURANT TO OCCUPY A PORTION OF THE "ROCKFORD SQUARE"
CONVENIENCE CENTER (MPUD 78-1) (89006)
WHEREAS, Trammell Crow Company has requested a Conditional Use Permit for a
Class II Restaurant to operate a 1,280 square foot "Pizza Hut" in a portion of
the Rockford Square structure; and,
WHEREAS, the area exceeds the maximum area for restaurant use of 4,000 square
feet approved with the MPUD Plan; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of
Trammell Crow Company for an amended MPUD Conditional Use Permit and for a
Class II Restaurant to operate a 1,280 square feet Pizza Hut located in the
Rockford Square structure, subject to the following conditions:
1. The permit is subject to all applicable codes, regulations and Ordinances,
and violation thereof shall be grounds for revocation.
2. The permit is issued to Pizza Hut of America, Inc. as operator of the
facility and shall not be transferrable.
3. The site shall be maintained in a sanitary manner.
4. Any signage shall conform with the City Ordinance standards and the
approved Master Sign Plan.
5. The permit for the Class II restaurant shall be renewed annually to assure
compliance with the conditions.
6. Compliance with applicable Building and Fire Code requirements shall be
verified by the City prior to Permit issuance.

7. All parking shall be off street in designated areas which comply with the
Zoning Ordinance and the approved Site Plan.
8. All waste and waste containers shall be stored within the structure and no
outside storage is permitted.
9. Hours of operation will be 11:00 a.m. to 12:00 midnight Sunday through
Thursday, and 11:00 a.m. to 2:00 a.m. Friday and Saturday.
10. The petitioner will monitor the condition of all delivery vehicles and
abate any noisy vehicles belonging to delivery drivers.
The motion for adoption of the foregoing Resolution was duly seconded
by rntinvilmember Ricker _, and upon vote being taken thereon,
the following voted in favor thereof: Mayor Schneider. Counc_ilmemberRicker,
yjtur and Sisk
The following voted against or abstainedCounciimember Vasiliou
Whereupon the Resolution was declared duly passed and adopted.
