HomeMy WebLinkAboutCity Council Resolution 1989-206CITY OF PLYMOUTH • Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 17th day of April , 1989. The following members were present: Mayor Schneider, Councilmembers Vasiliou , Ricker, Zitur and Sisk The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 89-206 REIMBURSING DEVELOPER FOR REQUIRED WATERMAIN CONSTRUCTION WILD WINGS 2ND ADDITION (88046) WHEREAS, the City of Plymouth and DeVries Builders, Inc., and David C. Bell Investment Company have entered into a development contract dated December 5, 1988, for the development of Wild Wings 2nd Addition; and WHEREAS, as part of this development the developer was required to construct a 1': inch watermain in Schmidt Lake Road through the Wild Wings 2nd Addition in order to conform with the City of Plymouth's overall Water Distribution Plan; and WHEREAS, the developer installed the required 12 inch watermain in Schmidt Lake Road within Wild Wings 2nd Addition; and WHEREAS, it is the policy of the City of Plymouth to reimburse developers for required watermain construction as provided for in the development contract; and WHEREAS, this amounts to $25,110.83 including engineering fees. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the developer, DeVries Builders, Inc. and David C. Bell Investment Company, are to be reimbursed in the amount of $25,110.83 for the required 12 inch watermain construction based on the alignment in the approved construction plans and in accordance with Section 3.3 in the development contract. BE IT FURTHER RESOLVED that the funds be allocated from the Trunk Water Fund. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider Councilmembers Vasiliou. Ricker, Zitur and Sisk , The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
