Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 6th day
of March , 19 89 The following members were present:

Councilmember zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 89-144
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
ROBERT PIERCE/B & H SUPPLY INC. FOR SHILOH PINES LOCATED AT THE WEST END OF
29TH AVENUE NORTH AND SOUTH OF COUNTY ROAD 24 (88025)
WHEREAS, Robert Pierce/B & H Supply Inc., has requested approval for a Final
Plat and Development Contract for Shiloh Pines located at the west end of 29th
Avenue North and south of County Road 24; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication according to the
Dedication Policy in effect at the time of filing the Final Plat.
3. No Building Permits shall be issued until a Contract has been awarded for
the construction of municipal sewer and water.
4. Removal of all dead or dying trees from the property at the owner's
expense.
5. Compliance with Policy Resolution No. 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.
6. No Building Permits to be issued until the Final Plat is filed and
recorded with Hennepin County.

7. Street Names shall comply with the City Street Naming System.
8. Approved variances for lot width for lots 2-5, Block 2.
9. An appropriate declaration, as approved by the City Attorney, shall be
filed with the County Recorder, indicating that no Building Permit will be
issued on any of the lots in this subdivision, until the existing
structures on proposed Lot 2 are removed or relocated to eliminate all
non -conforming yard dimensions on that lot.
10. Evergreen trees located within the construction zone of 29th Avenue North
will be relocated on site. Trees to be relocated shall be identified and
plans for relocation approved in advance by the City Forester consistent
with applicable terms of Paragraph 15 of the Development Contract for this
plat.
11. The Development Contract as approved by the City Council shall be fully
executed prior to release of the Final Plat.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Ricker , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Schneider, Councilmembers Ricker
and Zitur
The following voted against or abstained Councilmembers Sisk and Vasiliou
Whereupon the Resolution was declared duly passed and adopted.
