Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota was held on the 6th day of March ,
1989. The following members were present: Mayor Schneider, Councilmembers Vasiliou ,
Ricker, 7,itur and Sisk
The following members were absent: None
Councilmember Ricker introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 89-141
AMENDING RESOLUTION NO. 77-665
AUTHORIZING THE VACATION OF LANCASTER LANE
BETWEEN 8TH AVENUE NORTH AND 10TH AVENUE NORTH
WHEREAS, a petition was received to vacate Lancaster Lane between 8th Avenue North and
10th Avenue North and was approved by the City Council on November 21, 1977, Resolution
No. 77-665; and
WHEREAS, a public hearing with respect to said vacation was scheduled for March 6,
1989, in accordance with Minnesota Statutes 412.051 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of March 6, 1989; and
WHEREAS, the Council did hold a public hearing on March 6, 1989, to inform any and all
interested parties relevant to the vacation of certain drainage easements; and
WHEREAS, Paragraph No. 2 stated that said vacation shall not affect the auth6rity of
any person, corporation or municipality owning or controlling electric or telephone
poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or
thereunder, to continue maintaining the same or to enter upon such way or portion
thereof vacated to repair, replace, remove or otherwise attend thereto; and
WHEREAS, evidence in various forms from various utilities indicating that they no
longer claim any easement rights has been submitted to the City; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED EY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA: That the following easements reserved by paragraph 2, Resolution No. 77-665
be vacated:
The easements existing over, under and across that part of vacated Lancaster
Lane lying between 8th Avenue North and 10th Avenue North being in the
southeast 1/4 of the northeast 1/4 of Section 36, Township 118, Range 22,
Hennepin, Minnesota.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the following voted
in favor thereof: mayor Schneider. Counciimembers Vasiliou. Ricker. Zitur and Sisk ,
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
