HomeMy WebLinkAboutCity Council Resolution 1989-106CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 27tt, day of February 1989 The following members were present: Moor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION 89-106 APPROVING MIXED PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR OPUS COPORATION FOR TENNANT CORPORATE CENTER (88146) WHEREAS, Opus Corporation has requested approval for a Mixed Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for Tennant Corporate Center for one lot and one outlot on approximately 210 gross acres located at the northwest corner of County Road #18 (Highway 1.69) and County Road 10; and WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW THEREFORE, BE IT HERBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Mixed Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for Opus Corporation for the Tennant Corporate Center for one lot and one outlot located at the northwest corner of County Road X18 (Highway 169) and County Road 10, subject to the following: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for water and sewer. 4. Street names shall comply with the City Street Naming Systeri. 5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. No Buil"'3ng Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 7. Park dedication requirements shall be met through payment of fees in lieu consistent with the Park Dedication Policy and fees in effect at the time of Building Permit issuance. (see next page) Resolution No. 89-106 Page Two 8. The approved Development Contract shall be fully executed prior to release of the Final Plat for filing at Hennepin County. 9. All existing structures shall be removed at the owners expense prior to issuance of a Building Permit; this includes proper disconnection and termination of water and sewer services and on site systems. 10. Any underground storage tanks or reservoirs shall be properly removed and terminated. The motion for adoption of the foregoing Resolution was duly seconded by Gn inr JLMCMd ar 7ittir , and upon vote being taken thereon, the following voted in favor thereof: Ifa=r Schneiders Councilmemhers Vasiliou, Ricker. Zitur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
