HomeMy WebLinkAboutCity Council Resolution 1989-104CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 27th day of Eebruaru 1989 The following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION 89-104 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR HOLZER'S IMPORTED CAR SERVICE, INC. (88143) WHEREAS, Holzer's Imported Car Service, Inc. has requested approval of a Site Plan and Conditional Use Permit for major automobile repair to be located at 11318 Highway 55; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Holzer's Imported Car Service for a Site Plan and Conditional Use Permit for major automobile repair to be located at 11318 Highway 55, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 3. Any signage shall be in compliance with the Ordinance requirements of the City of Plymouth. 4. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 5. All waste and waste containers shall be stored within the enclosure, and no outside storage is permitted. 6. An 8-1/2 x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. (see next page) Resolution No. 89-104 Page Two 7. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 8. The permit is issued to Holzer's Imported Car Service, Inc. as operator of the facility and shall not be transferable. 9. The site shall be maintained in a sanitary manner. 10. There shall be no outside or inside display or sales, and no outside storage of vehicles, merchandise or related materials. The keeping of customers' vehicles under repair for up to 3 business days shall not constitute "outdoor storage of vehicles". 11. The permit shall be renewed in one year to assure compliance with the conditions. 12. Compliance with applicable Building and Fire Code requirements shall be verified by the City prior to Permit issuance. 13. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: mayor Schneider- Caun + ®e hwra Vaailirn,`Ricker, Zi tur and Sisk The following voted against or abstained Nona Whereupon the Resolution was declared duly passed and adopted.
