HomeMy WebLinkAboutCity Council Resolution 1989-050CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 23rd day of January , 1989. The following members were present: Mayor Schneider, Councilmembers Vacilioi , Ricker and Sisk The following members were absent: Councilmember Zitur *** *** *** Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 89-50 REDUCING DEVELOPMENT BOND ST. MARYS ADDITION (85119) WHEREAS, in accordance with the development contract dated March 11, 1986, revised September 10, 1987, David A. Williams Realty and Construction, Inc., developer of St. Marys Addition (85119), has agreed to install certain improvements for said development; and WHEREAS, the developer has completed a portion of the street, utility and site grading as noted below; and WHEREAS, the developer has requested a reduction of the development bond to reflect the completed work; OpNOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA; that the bonding requirements are reduced as follows: Street Construction * $ 6,500 * $ -0- Sanitary Sewer 2,700 -0- Watermain -0- -0- Storm Sewer 2,800 -0- Boulevard and Drainage Swale Sod 800 800 Pond or Ditch Construction -0- -0- Street Signs -0- -0- Site Grading and Drainage Improvements 22,600 -0- Park and Trail Improvements -0- -0- Design, Administration, Inspection, As-Builts 4,248 ___m TOTAL $ 39,648 $ 896 That the letter of credit required for the above items be reduced as detailed above from $39,648 to $896 to reflect the completed work. * Note: The developer submitted a cash payment on January 18, 1989 in the amount of $7,280 in lieu of constructing a portion of Forestview Lane at this time. Resolution No. 89- 50 Page Two FURTHER BE IT RESOLVED that the bonding requirements for the following items per Section 8.1 of the approved development contract be reduced as follows: ITEM ORIGINAL AMOUNT NEW AMOUNT Maintenance of Erosion and Sediment Control Plan Street Sweeping and Storm Sewer Cleaning Cash: $1,000 $1,000 Letter of Credit: $9,000 $2,250 FURTHER BE IT RESOLVED that the sanitary sewer, watermain, and storm sewer construction is accepted for continual maintenance as of January 23, 1989, subject to the One Year Guarantee by the Developer. In lieu of the required maintenance bond the developer has submitted a cash deposit in the amount of 10% ($652.50) of the contract amount for these utilities. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Ricker and Sisk , The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
