Vasiliou The following members were absent: zitur rminrilmi-mh r Sisk introduced the following Resolution and moved its adoption: RESOLUTION 89-33 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR ZACHARY HEIGHTS FOR GRAHAM DEVELOPMENT CO. (88042) WHEREAS, the City Council has approved the Final Plat and Development Contract for Zachary Heights as requested by Graham Development Co.; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of filing the Final Plat. 4. No Building Permits shall be issued until a Contract has been awarded for the construction of municipal sewer and water and the MPCA Permit is issued. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. No yard setback variances are granted or implied. Minimum yard setbacks are: a. Front yard - 35 feet b. All yards abutting Schmidt Lake Road and Zachary Lane - 50 feet c. Side yard - 15 feet d. Rear yard - 25 feet (see next page) Resolution No. 89-33 Page Two 8. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 9. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 10. Access shall be limited to internal public roads and prohibited from: Schmidt Lake Road and Zachary Lane. 11. Subsequent phases shall be subject to Ordinance provisions for Plat applications for the review and approval. 12. The development of Lot 12, Block 1, shall follow all recommendations made by Dr. French of the University of Minnesota; and, that Dr. French shall supervise and guarantee there shall be no removal of hardwood trees. 13. The owner shall provide the appropriate document approved by the City Attorney granting a private easement between Lots 5 and 6, Block 1, for future driveway relocation and public street access for the exception parcel on Zachary Lane (the former Jeff Howard home). 14. The corner lots along Schmidt Lake Road shall have the driveways located as far from Schmidt Lake Road as practical (Minimum of 50'). 15. A binding agreement by Graham Development providing that should the City of Plymouth determine a need to acquire the portion of the Schmidt Lake Road right-of-way not included in this portion of "Zachary Heights" Final Plat, Graham Development will reimburse the City of Plymouth for those acquisition costs to the extent to which the City is n-1 able to assess those costs to the McNeal, Inc. property, if Graham Development finally plats the McNeal property. 16. The driveway for the existing home shall be closed and relocated to 51st Avenue North by July 1, 1989. 17. Appropriate legal documents establishing a covenant on the property shall be approved by the City Attorney and filed at Hennepin County with the final plat establishing the location of Schmidt Lake Road in accordance with Alternative Alignment No. 1 and its future construction. The purpose of the covenant is to make sure all property owners have prior notice of the ultimate construction of Schmidt Lake Road. 18. Filing of this plat shall take place prior to, but concurrent with, the filing of the final plat of Wild Wings 3rd Addition. 19. The Development Contract as approved by the City Council shall be fully executed prior to release of the Final Plat. (see next page) 0 Resolution No. 89- 33 Page Three 20. Development signage showing the entire development, inclusive of Schmidt Lake Road, shall be placed at the main entrance to the development. The sign plan shall be approved by the City prior to installation. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Ricker and upon vote being taken thereon, the following voted in favor thereof: Schneider, Sisk, Ricker, Vasiliou The following voted against or abstained_ None Whereupon the Resolution was declared duly passed and adopted.
