HomeMy WebLinkAboutCity Council Resolution 2013-331CITY OF PLYMOUTH RESOLUTION No. 2013-331 A RESOLUTION AFFIRMING CITY STAFF'S INTERPRETATION OF THE CITY'S ZONING ORDINANCE PERTAINING TO DOCKS (201 3089) WHEREAS, on September 10, 2013, Daniel Gustafson requested an appeal of the interpretation of a dock as an accessory use that cannot be constricted prior to the time of constriction of the principal building to which it is accessory. WHEREAS, when hearing an appeal, the City Council acts in its capacity as the Board of Adjustments and Appeals. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does affirm City staff s interpretation of the Plymouth Zoning Ordinance regarding the classification of docks: 1. A dock is an accessory stricture. 2. City staff correctly interpreted the applicable provisions of the Plymouth Zoning Ordinance regarding the classification of a dock as an accessory use that cannot be constricted prior to the time of constriction of an allowed principal building to which it is accessory. ADOPTED by the Plymouth City Council on October 8, 2013. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
